Korea rental contract: the details to complete before a foreign tenant signs

A practical pre-signing check of the property address, parties, deposit, term, signatures and broker documents—before relying on a fixed date or deposit protection.

1. A blank line is not a small detail

Korea Easy Law states that there is no single mandatory form for a residential lease. However, to obtain a fixed date, the lease document must be complete: it needs the landlord and tenant details, the leased home, the term and the deposit, and it must carry the parties’ signature or seal. A receipt with a missing home or term is not a substitute. Before signing, complete the unit identifier down to building, floor and unit where applicable; list the deposit, monthly rent, payment dates and lease period; and draw a line through unused spaces before the parties sign or seal.

2. Make the address identical across the file

The address in the lease should match the registry, the actual unit and the document used for residence or address reporting. Easy Law highlights a case in which a different unit number on the lease and address registration meant the tenant could not rely on the expected opposability and preferential repayment. That does not make every typo a legal conclusion, but it is a strong reason to stop and correct an inconsistent building, floor or unit number before funds are transferred. Ask the agent to show the current registry and confirm the exact legal unit identifier in writing.

3. Leave with a three-document set

Where a licensed Korean real-estate broker handled the lease, official guidance says to receive the lease agreement, the property explanation-and-confirmation form, and the broker’s compensation-guarantee certificate. These are different documents: receiving one does not prove that the other two were delivered. Keep scans of signed originals, the transfer receipt, the registry checked before payment and any filed-report receipt. Foreign tenants should separately confirm their residence-status and address-reporting route with the relevant authority; a broker cannot decide immigration eligibility for them.
